What to Expect After Filing for Bankruptcy

The bankruptcy process, while ultimately liberating, understandably tends to wear on a person’s nerves. Many worry about how the bankruptcy judge will perceive them. Will they judge them harshly for their financial issues? Will they have to meet with creditors that are impolite and unprofessional? If you are filing for bankruptcy, know that while this process can be stressful, it can be made far less stressful by having an experienced Las Vegas, Nevada debt attorney in your corner. The team at Ballstaedt Law Firm understands this process inside and out and we’re happy to answer any questions you have so that you can set your mind at ease.

Should I Worry About Being Judged?

Our experienced Las Vegas, NV debt attorney team knows how the bankruptcy process works and will ensure that all of your paperwork is correct, at every step along the way. Your paperwork will need to accurately reflect your financial situation before a judge will approve your bankruptcy petition. Try not to worry too much about what the judge will think of you and your financial reality. Judges are not going to judge you. The judge assigned to your case hears bankruptcy cases all of the time and he or she will almost certainly remain professional throughout the entirety of your hearing. Everyone has bad days, so it is possible that the judge will say something that makes you wonder if you’re being judged. But if that happens, that is a situation that reflects poorly on the judge, not on you. With that said, if you’re worried about feeling anxious during any step in this process, don’t hesitate to let our Las Vegas, NV debt attorney team know so that we can help you understand what to expect and set your mind at ease.

Will I Meet With Creditors?

Your bankruptcy case will be assigned a trustee. The trustee will oversee a “meeting of creditors” in which your creditors may or may not show up. Most of the time, unless your debts are particularly complex, your creditors probably won’t bother to show up. Instead, you’ll simply answer some questions (under oath) posed by your trustee and you’ll be on your way. This is a meeting that is meant to clarify the information that you reported in your bankruptcy paperwork. If a creditor shows up and tries to object to your plan for bankruptcy, then you may have to go in front of a judge with that creditor to come up with a plan or to argue your case for bankruptcy. But if this happens, your Las Vegas, NV debt attorney will know how to navigate the situation so it shouldn’t serve as much cause for concern.

Harlene July 2010 – I had put off filling for a while. I was kind of afraid of the unfamilar. The staff was amazing, and made me feel good about what I needed to do. Seth, was right to the point and got things handled. I am very pleased.
